1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us such as name, address, contact information, passwords and security data, and payment information.

We collect personal information that you voluntarily provide to us when registering at the Sites expressing an interest in obtaining information about us or our products and services, when participating in activities on the Sites (such as posting messages in our online forums or entering competitions, contents, or giveaway) or otherwise contacting us.

The personal information we collect depends on the context of your interactions with us and the Sites, the choices you make and the products and features you use. There personal information we collect can include the following:

Name and Contact Data. We collect your first and last name, email address, postal address, phone number, and the similar contact data.

In Short: Some information — such as IP address and/or browser and device characteristics — is collected automatically when you visit our Sites.

2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes bases on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Sites for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

  • To facilitate account creation and logon process. I you choose to link your account with us to a third party account *(such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process.
  • To send you marketing and promotional communications. We and/or our third party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time (see the “ WHAT ARE YOUR PRIVACY RIGHTS “ below).
  • To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.
  • Fulfill and manage your order. We may use your information to fulfill and manage your orders, payments, returns, and exchanges made through the Sites.

6. DO WE USE GOOGLE MAPS?

In Short: Yes, we use Google Maps for the purpose of providing better service.

By using our Maps API Implementation, you agree to be bound by Google’s Terms of Service. 

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep our information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than 2 years past the termination of the user’s account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Sites is at your own risk. 9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age. 

We do not knowingly solicit data from or market to children under 18 years of age. By using the Sites, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Sites. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 10. WHAT ARE YOUR PRIVACY RIGHTS?

These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request please use the contact details provided below. We will consider and cut upon any request in accordance with applicable data protection laws. 

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal.

Account Information

If you would at any time like to review or change the information in your account to terminate your account, you can:

  • Log into your account settings and update your user account.
  • Contact us using the contact information provided. 

Upon request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements. 

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Sites. Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account. To otherwise opt-out, you may:

  • Note your preferences when you register an account with the site. 
  • Access your account settings and update preferences.

11. CONTROLS FOR DO-NOT-TRACK FEATURES?

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be traced online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy. 

12. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information. 

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below. 

If you are under 18 years of age, reside in California, and have a registered account with the Sites, you have the right to request removal of unwanted data that you publicly post on the Sites. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Sites, but please be aware that the data may not be completely or comprehensively removed from our systems. 

13. DO WE MAKE UPDATES TO THIS POLICY?

In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws. 

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information. 

14. THIRD-PARTY LINKS, CO-BRAND RELATIONSHIPS, & PUBLIC FORUMS

In an attempt to provide increased value to our Users, BarreAmped may choose various third-party web sites to link to, link from, and frame within, the Website.

BarreAmped also may participate in co-branding and other relationships to offer e-commerce and other services and features to its users. However, even if the third party is affiliated with BarreAmped, we have no control over these linked sites, each of who have separate privacy and data collection practices independent of BarreAmped. We have no responsibility or liability for these independent sites’ policies or actions, and are not responsible for the privacy practices or the content of any such web sites. Please make sure you are comfortable with the privacy practices of every site you visit before providing the site with your personal information. These linked sites are only for your convenience and you therefore access them at your own risk.

We also may make chat rooms, forums and message boards available to you on the Website. We do not, however, monitor the chat rooms, forums or message boards, do not moderate them, and you agree that we have no obligation to do so. We cannot and do not control the information that is shared by members. Anything you voluntarily provide in any public area of the Internet will be publicly available to other visitors on that web site and potentially to other third parties. You should exercise caution when deciding to publicly disclose any of your personal information in these and similar areas.

We collect information about you during the course purchase process (PayPal, Stripe, and/or 2Checkout), as well as information relating to your course progression and quiz performance.

When you purchase from us, we’ll ask you to provide email address. We’ll use this information for purposes, such as, to:

— Send you information about your account and order

— Create your account for our LMS

If you register a free account then we will store your email address.

We store information about you for as long as your account exists.

We store course progress, including completion status, quiz scores, assignments and/or essay submissions (if applicable).

We will also store comments on courses, lessons, topics, assignments, and essays if you choose to leave them.

Who on our team has access?

Members of our team have access to the information you provide us. For example, both Administrators and Group Leaders can access:

—Order information such as your enrolled courses, course progress and username / email address.

Any additional information added in your WordPress User Profile can also be visible to the administrator(s).

We collect information about you during the checkout process on our store.

What we collect and store

While you visit our site, we’ll track:

  • Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
  • Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
  • Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!

We’ll also use cookies to keep track of cart contents while you’re browsing our site.

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

  • Send you information about your account and order
  • Respond to your requests, including refunds and complaints

  • Set up your account for our store
  • Comply with any legal obligations we have, such as calculating taxes

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.

We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for 2 years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.

We will also store comments or reviews, if you choose to leave them.

Who on our team has access

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

  • Order information like what was purchased, when it was purchased and where it should be sent, and
  • Customer information like your name, email address, and billing and shipping information.

Our team members have access to this information to help fulfill orders, process refunds and support you.

What we collect and store

For the purposes of processing recurring subscription payments, we store the customer’s name, billing address, shipping address, email address, phone number and credit card/payment details.

We collect information about visitors who comment on Sites that use our Akismet anti-spam service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).

What personal data we collect and why we collect it

Event, Attendee, and Ticket Purchaser Information

If you create, submit, import, save, or publish event ticket information, as well as RSVP or purchase tickets to events, such information is retained in the local database:

  1. Attendees information (RSVPs and Tickets): name and email address
  2. Ticket information (RSVPs and Tickets): name, email address, and ticket number/SKU (via check-in page)
  3. Ticket purchaser information: name and email address
  4. Ticket purchaser billing address, which is collected through the use of WooCommerce, Easy Digital Downloads, or PayPal

Please note: The website owner can collect nearly any Attendee Information requested from ticket buyers by creating a custom registration form.

API Keys

Events Tickets suite offers the use of third-party API keys. The primary functions are to enhance the features we’ve built in, some of which use Google Maps and PayPal. These API keys are not supplied by Modern Tribe.

We make use of certain API keys, in order to provide specific features.

These API keys may include the following third party services: Google Maps and PayPal.

What personal data we collect and why we collect it

Event, Attendee, and Organizer Information

  1. Venue information: name, address, city, country, state, postal code, phone, website, geographical coordinates (latitude and longitude)
  2. Organizer information: name, phone, website, email
  3. Event information: website, cost, description, date, time, image

Importing Events, Venues, and Organizers:

  1. All data present within a CSV or ICS file and external URLs (for events, venues, organizers, and tickets)
  2. Import origin data (URL from where events are being imported—such as Eventbrite, MeetUp, other compatible URL sources, and more, which can include similar or same data as listed above)
  3. Eventbrite Ticket information: name, description, cost, type, quantity

Please note that to create new events through the Community Events submission form, a user must hold a website account on this domain. This information is retained in the local database. It is also possible to create events anonymously, if the site owner has this option enabled.

When purchasing Eventbrite Tickets, attendee, purchaser, and order information are stored and managed by Eventbrite.

API Keys

We make use of certain API keys, in order to provide specific features.

These API keys may include the following third party services: Google Maps, Meetup, PayPal, and Eventbrite (API key, auth URL and Client Secret).
